Terms of Use

Last updated 20 October 2026 · Effective 20 October 2026

About these terms#

These terms are an agreement between you and Sultan Mustafin, an individual entrepreneur in the Republic of Kazakhstan, trading as Marchbird ("we", "us"), for the Archer Phalanx game for iPhone ("the game"). By downloading or playing the game you agree to them. If you don't agree, please don't use the game.

Our Privacy Policy explains how information is handled.

Your licence#

We give you a personal, non-exclusive, non-transferable, revocable licence to download and play the game for your own non-commercial entertainment, on Apple devices you own or control, as allowed by the App Store's usage rules. The game is licensed to you, not sold.

Apple and the Standard EULA#

Apple's Licensed Application End User License Agreement (the Standard EULA) also applies to the game. These terms add to it; if the two conflict, the Standard EULA wins for the matters it covers.

These terms are between you and us, not Apple. Apple isn't responsible for the game or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Coins and other in-game items#

Coins, upgrades, commanders and other in-game items are part of your licence to use the game. They have no cash value, can't be exchanged for real money or anything else outside the game, and can't be sold or transferred.

Your progress is saved only on your iPhone, so deleting the game, or losing the device without a backup, deletes it. We can't recover lost progress. We may rebalance or change in-game items in updates.

Purchases and refunds#

All purchases are processed by Apple under the App Store's terms. Prices are shown in the App Store and may vary by country. Purchases you've made (Remove Ads, Starter Pack) can be restored on the same Apple Account with Settings › Restore purchases in the game.

Refunds are handled by Apple: you can request a refund from Apple. We can't issue refunds ourselves, because we never receive your payment details.

Ads#

The game shows ads from third parties. Rewarded ads are optional, and their reward is given once the ad is complete; sometimes no ad is available. We aren't responsible for the content of third-party ads or for the apps and websites they lead to. Remove Ads stops the ads between runs; rewarded ads stay available.

Acceptable use#

Please play fair. Don't:

  • copy, modify, decompile or reverse engineer the game, except where the law allows it;
  • use cheats, bots or modified versions of the game, or exploit bugs to get rewards;
  • interfere with the game's ads, for example with fake clicks or automated views;
  • use the game for anything unlawful.

Intellectual property#

The game, including its code, art, music, sounds, text and the names "Archer Phalanx" and "Marchbird", belongs to us or our licensors and is protected by law. These terms don't give you any rights to them except the licence above.

Updates and availability#

We may update the game, change or remove features, or stop offering it. Some parts, such as ads, need an internet connection. We'll try to keep the game working well, but we can't promise it will always be available or free of bugs.

Disclaimer#

To the extent the law allows, the game is provided "as is" and "as available", without warranties of any kind, whether express or implied. This doesn't affect any rights you have as a consumer that can't be excluded by agreement.

Limitation of liability#

To the extent the law allows, we aren't liable for any indirect, incidental, special or consequential loss, or for loss of progress or data, arising from your use of the game. Our total liability to you for any claim is limited to the amount you paid for in-app purchases in the game in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

Termination#

You can stop using the game at any time by deleting it. If you seriously break these terms, your licence ends. The sections on in-game items, intellectual property, the disclaimer, liability and governing law still apply afterwards.

Governing law#

These terms are governed by the laws of the Republic of Kazakhstan, and disputes go to the competent courts of the Republic of Kazakhstan. If you play as a consumer, you also keep the protection of any mandatory laws of the country where you live.

Changes to these terms#

We may update these terms when the game changes or the law requires it. The latest version is always on this page, with the date at the top. If you keep playing after a change, the new terms apply.
